it's just like formula 1 a set of rules are brought in,and it's then up to the teams to come up with something that is really close to breaking the rules,interpretation.it's all about dotting the i's and crossing the t's and if it isn't done correctly then you aint broke no rules,and would you expect wigan to ask the RFL could we deffair payments?they suddenly relise there is no rule so they tell us to wait a few days while they discuss it,and in the meantime slip the new rule in.

I'm sorry - that was 2005 wasn't it? Last year our squad had injuries but the reason we were in the relegation zone was a combination of Millward losing the dressing room and terrible recruitment decisions. At one point it looked like we were going to go into the season without a scrum half (after the whole Moran debacle I wish we had of done)! Even that probably isn't as black and white as we'd think - it was all tied up in the departure of Luke Robinson and Andy Farrell.

In 2006, ML and DW decided to keep Wigan up even if it ment almost certainly breaking the cap. I believe it was as simple as that. If I'm correct, then we deserve the punishment we got and we should take it on the chin and promise never to do it again (unless we need to). Trying to find a loophole certainly is against the spirit of the cap. Maybe we could have all our players on perminantly deferred contracts and only pay them after they have retired through an "insurance" company or something. Its ridiculous.

Having said that, I hope we win any appeal - if just to wind up everyone else even more. We'd have a chance if it was before an independent judge like the first one, but the RFL would never let us win if it is in their hands.

I have made some t-shirts for the next few weeks we can wear them in groups at matches... anyone like one??? £39.99 each, £19.99 P&P... all proceeds go towards the cap...

Mike you know and I know that as regards financials matters, the 'spirit of whatever regulations are created' are stretched. We even employ accountants to stretch them to the limit.

A counter argument. Whether people like it or not. We could have simply broke the cap and said fine, 4pts lost. That would be breaking the rules. We instead tried to find a way of doing the best for Wigan RLFC whilst staying within the cap. The route we chose actually self inflicted punishment upon ourselves. We have had to operate with a reduced salary cap in the present season to accomodate the deferred payments. Saints and Bradford overspent and carried on as normal.

Would people have rather we had done nothing and been relegated? Lost every single player under freedom of contract regulation following relegation?

Rule 1.3 surely cannot stand up in law :conf:

I'd have to ask my employees first to take a pay cut... but yes. Trading standards however will accuse me of over payment

I will deposit my money offshore so you don,t pay tax as long as you meet me halfway in refunding what I pay :wink: that way we won't end up in any crap :blush:

Think about it though. Last game of the season. SAfe from relegation even if the RFL deduct the maximum number of points. You pay every player their salary in advance thereby freeing the whole cap for the next year to add more players and win every competition. :o Do you think I should contact ML/DW with my idea :)
