Because those are the rules. As GeoffN pointed out attempted murder is a crime that is based on proving, beyond reasonable doubt, that the intent was there to murder someone. You don't have to actiually go through with it to be convicted.
It is the same (but to a much lesser degree of course) in RL. If you take a swipe at someones head, even if you miss, there is nothing to stop you getting banned.
He admitted what his intensions were. Read the ruling. He accepted his guilt for the Gilmour incident (and just appealed the sentence) and the Long appeal was what he led with shoulder not the elbow and the also severity of the senrtence.How do you know what Newton's intention was? In any case, I think it is pretty obvious Newton had lost the plot and was out to clobber Long. If I think that I am sure plenty of other people do based on watching the video back. If the panel have formed the same opinion, that he intended to hurt Long, then they can ban him.
It is at rhe end of the day a judgement call and if the panel judge the intent was there, they will ban players.
Now on the other hand had they judged Newton caught Gilmour accidentally he could very well of got off with a warning about his tackling. Then again he might still have been banned due to his past record. In this case he admitted his guilt over that tackle so had not got a leg to stand on but the point is the panel can take all sorts into account. Past record, their judgement of intent and even, it seems, medical reports on an injury.
