As others have said you can't force a player out of the club who has a contract. Contracts favour the players.

If a player wants to leave early he usually gets his way and we have had several examples of those at the club recently, Barrett being the latest.

We have also had players who people could not wait to see the back of e.g. DV but they saw their rumoured lucrative deals out. Calders is another. He had an option in his favour that said if he wanted to make his two year deal, three he could (and he did). Nothing the club could do about it or DV.

If Feka lets the club talk him into leaving then I can only assume he is being badly advised of his legal rights. He doesn't need to ask to stay - he can just tell them he isn't leaving!

The club could try sacking him either over the court case or fitness (but the latter would fail given it continues to play him I'd guess) but if it did then he becomes a free agent as mentioned by someone previously, not a bargaining chip in a deal for another player.

The fact the club said at the forum, in public, he is overweight but it didn't pressure him into sorting the issue out due to the court case undermines both arguments for sacking anyway. First because it clearly didn't ask him to address the issue and second because this implies support of the player over the court case.

It can't support him one minute and then sack him over the same issue weeks after it's been resolved and expect to win any unfair dismissal case that may arise.

In short unless sacked the ball is in his court as to whether he stays or goes and someone ought to tell him.

Dave

Can’t disagree with what you have written:

But if they tell him they are not going to play him and bonuses will not be coming his way along with telling him he is not wanted at the club....Now what does he do if he wants to play rugby and is made to feel unwelcome? They can make your life difficult if they want to. But you are right he does not need to go!

They could - but the risk a charge of constructive dismissal in an employment tribunal. Effectively forcing out unwanted players is illegal whether you boot them out or put them in a position where they have no choice but to leave.

Also the club would surely realise that they face a public relations disaster - Feka is one of the most entertaining and popular players at the club - there would be an uproar if he were forced to leave against his will.

Lastly if Feka was smart and said "fine; I'll sit in the stands" - then the club would be using a large portion of the salary cap on a player that would do nothing other than ferment dissent in the camp - because if he were treated like this then it is a fair bet that the other players could realise that it could happen to them - and look towards other options which would destroy team spirit

What would happen if he went to a club with a decent fitness coach and the will to prove Wigan wrong. A fitter faster Fika coming at us longer. Ask the props if they relish the posibility,
Jim

not problem solved!

our four frontline props next year will be

feka
fielden
coley
carvell

with prescott and o'carroll as back up, with one of these 2 players being loaned out so they gain experience! this in my opinion could match our pack of pongia, smith,o'connor and sculthorpe.
dont get your hopes up mate he will not be joining wigan..wants too much money he is saints bound!

getting rid of coley would be a bad move he has a very good engine and for his size he can motor. he has fitted in fine to our team i belive.
