They can close that strategy off subsequently by amending its regulations BUT it cannot apply something retrospectively.
And THAT might be exactly the reason why we went through that first hearing, because that agreed that the RFL could NOT apply things retrospectively, namely the doubling of the penalties for breaching the cap. Nothing to do with the number of points themselves, and as I noted elsewhere we only drop one more place if we lose 8 points instead of 4 (although we then end up battling with Salford and HKR instead of being on the edge of the play-off battle), but this issue of retrospective rule changes might be the key to an appeal if we make one.

So we have been found guilty by default (players deferring wages), so what about clubs that can pay players a higher wage by using offshore accounts.
Is that not in the spirit of the cap? :conf:
This is something i to would love to have cleared up.

Whilst I accept that we broke the rules clearly, why do clubs that pay offshore get away with it.

It is far too easy to shout and scream for heads.

We need answers and we need the full story as to why the club and RFL disagree to such a large amount over the cap figure allocated to Wigan RLFC.
But you must agree, either Maurice is incompitent this is why we havent competed in Super league with the salary cap in place and we never will with him in charge.

Or something is rotten in Denmark with the R.F.L and there needs to be a serious inquiry as to why Wigan were alowed to sign Fielded thus letting Wigan go over the cap.

I think Maurice was lying through his teeth with the Fielden signing god knows what its going to be like next year with Barrett and Bailey on board.

why get the chairman out when we're 9th in the league :S we need to concentrate onour game not be distracted by off field events.

if we do not appeal then we know someones sums were way out,and if that's the case then i would protest about our club's name being dragged through the dirt again.we can defend going over once but if it is by so much and not a matter of opinion as to how and when payments were made then that is unforgivable. THEN LET'S PROTEST :exc: :exc:

Problem is, if Chairman Mo really is incompetant (and as I've said elsewhere, I wait to be totally persuaded), if the team do really well, maybe even win the double (still possible) then will people start to forget the salary cap stuff? I know I'm sitting on the fence here and playing both sides, but if he's totally useless then he needs to go, and there should be no escaping that. It's a difficult one, and to be honest the whole salary cap thing is only going to be resolved next year when it's done at the time. It's the only way to do away with all the rumour and speculation, unless the RFL do the right thing and make all the books for all the teams (and the rules!) public so we can all see what is going on.

Lancaster, the cap must be in order currently. I believe the RFL now check it continuously. Therein, lies another example of how poorly organised the RFL is, with salary cap reviews in the past taking place retrospectively.

Standish no you would not. If I showed you a loophole to avoid paying tax you would take it until the Government closed that loophole. The Government could not punish you unless you broke that law AFTER it was introduced. If the Government cannot punish you retrospectively then how the hell can the RFL do so.

Remember, this is the RFL who cleared the signing of Fielden and must have known about the deferred payments back then. This is the RFL who drafted an illegal salary cap document. They could not organise a piss up in a brewery

Top companies pay a fortune to accountants to do exactly what Wigan RLFC have done. It is legal.

Every club in the RFL bar Wigan use offshore accounts. I am not sure if that is legal or illegal BUT it is no different to what Wigan RLFC have done.

Chris has gone mad !!!

I have no problem getting behind the team but my friend the long and the short of it is that off the field politics will affect the performance.
What do you suggest Chris let maintain the Status Quo and i will se you here this time next year to lick our wounds after a 12 point deduction.

BBC sport states that NINE players aggreed salary deferrals NINE !!!!! my good god we only signed Fielden so NINE of the shower that started last. We needed that many people to take a deferral to get us below. How much are these under achievers on exactly. When will the Chairman whoever that be walk into the dressing room and say to these guys i need to CUT (not deffer) your wages. You get 2 choices you can either stay and play for this great club or you can go and find your fortune elsewhere. THAT IS CALLED MOTIVATION.
