If we used a loop hole we should be ok, if there not happy with it they would have to change the rules to close it but cant then retrospectively have us in trouble for using it

If Wigan have not actually paid out Salaries over the cap then a loophole should have nothing to do with it. If the thread is true then Wigan are innocent!

The RFL has taken the view that the contractual salary
agreements we had are valid and although we have not
actually paid that much, they say we cannot defer
payments in this fashion. Wigan have taken the advise
of a top sports barrister who says the RFL have no
case to dock any points and will take them to the
cleaners if Wigan are docked.
The RFL have had full knowledge of all this in the
loop and it explains why our squad, while overall good
quality, is paper thin. It also explains why McAvoy
was binned despite public promises to make good his
contract on a permanent basis. The RFL would not
register him as a player for us.
Good ploy. Take them to court. The way courts are jammed up we will be safe in the franchise by the time a date is set, :sly:

There's certainly nothing in the rules (as published by the RFL) to say that deferred payments count. Everything in the rules refers to money (or benefits) actually paid in that season.
Even if we do succeed though, it limits our space under the cap for this season (if some of last year's is being added on).

what happens when the francice system comes in,re the salary cap will it go up,down or stay as is?we might drag the payments out until the cap changes.

Just another point about this, did anyone else hear SF on rugby show sunday. when he said "the club as told us we should be fine". So maybe nobby as had them in talkin about it.
