I would be willing to acknowledge that.

But if you are correct, then the RFL have some questions to answer because it would mean the whole salary cap scrutiny process is a bit ridiculous IF it has already been determined what the penalties are before anyone has even looked at the accounts.

But the penalties are set on a sliding scale based on how far you go over the cap. So to for Hull to get four points deducted next season they would have to have exceeded this years cap by the same amount we exceeded the cap in 2005 (as the penalties have doubled).

So unless people know what the figures are for these clubs, how can they say what the penalty is going to be?

Hence my "IF". I don't believe this myself, I still have some faith in the auditing process but then this sport still manages to throw surprises from time-to-time so perhaps it shouldn't be totally discarded...
