Why?

Well I have had numerous arguments with fans from other clubs who have claimed they exploit the rules better than Wigan do who also ignore the implications of doing so because it suits them.

I am talking about using offshore benefit trusts for tax avoidance (rather immoral IMO), signing Kolpack players rather than running a full academy to save cash on the cap and as Saints did putting out a weak side that was legal by the rules but not in the spirit of them.

So if Wigan get the RFL to acknowledge we have technically done nowt wrong I would just love to see the hypocrisy of fans from other clubs.

Mind you whatever the outcome I will be away on holiday on the 25th so I will miss all the fun!

Dave, forgive my ignorance but can you please explain the Kolpack bit, I don't know what it means.

It is an EU law thing. The EU has what are known as Association Agreements with countries outside the EU. This allows workers form those countries to work in the EU with the same rights as EU citizens.

In Germany they had a rule in basketball that said you could only have two overseas players. One team employed a bloke called Kolpak who was from Czechoslovakia. The governing body of the sport said Kolpak counted as an overseas player.

He challenged this on the basis that other Czech nationals could work freely in Germany because Czechoslovakia had an Associate Agreement with the EU.

He won.

So this means foreign players who come from countries which have an Associate Agreement with the EU can't be treated as overseas players so they don't count on the overseas quota.

This has lead to teams like Wakey having 16 "foreign players" on the pitch as they did last season v Cas in the relegation decider. This is because the EU has Associate Agreements with many south sea island countries. Players like Feka are technically from these places even if they may have spent the majority of their lives in NZ so they don't count on the quota.

In the past other clubs exploited this rule to the full to employ lots of NZ players who don't count the oversea quota despite the fact it potentially keeps UK players out of the side. Clubs don't have to employ these players but they do because the rules allow it.

You are welcome.

The other thing that impacts on this is players with EU passports don't count on the quota either. By this I mean for example Aussies who can get an EU passport.

So combine that with the Kolpak rule and it is quite easy to assemble a side of "foreign" players.

Unfortunately Wigan have gone a bit down this route this season.

Our Kolpak players are Feka, TL, DV.

Our EU passport carrying players are Richards, Millard, Hansen (Kiwi international but has EU passport) and before he retired Withers.

Our on-quota payers are Fletch, Barrat and Bailey.

So before Withers retired you could argue we had 10 overseas players 7 of which escaped the quota because they were either Kolpak or EU passport holders. Not good IMO but not as bad as Wakey and their 16.

Spot on,as i said the performances on the park by cas where utter garbage, ok they had a few scalps along the way but they just werent good enough and there coach and chairman hadnt a clue how to get themselves out of that hole in my opinion thats lack of experience thats why cas went down.

You probably also read that Richard lewis is coming under a lot of criticism for the wigan "stunt" as its called.

I personally have no sympathy for anyone at Redhall, they have sat back for way to long and thought that they had the perfect set of rules and no one could challenge them, i always work on the principle of rules are there to broken some one regularly does it and RFL respond and this highlights how poor the rules are and probably poorly written.

Still as at today we are guilty of absolutely NOWT! so lets wait and see!
yes I did read about lewis coming under a lot of critism for the wigan stunt what wigan stunt are stains and brad'sjust suddenly forgotten why is it just us in the hearing stains and brads gave evidence to back us up about using last years rules it's bloody ridiculus (sp) :angry:

A good argument against the cap. NRL clubs have suffered higher rates of injuries this season. Several coaches statee that due to the cap they are being forced to play unfit players because they do not have enough strength in depth. Ricky Stuart says this season is the first ever he has selected players unable to train during the week.
